This lecture comments on the manner in which modern slavery thrives in American prisons. It analyzes the invisibility of modern, legalized slavery permitted by the Thirteenth Amendment’s exception for “conviction” or incarceration. Unlike the robust scholarship examining the Fourteenth and Fifteenth Amendments, by comparison in scale and scope, the Thirteenth Amendment remains a foregone conclusion and thus surprisingly and virtually unstudied.
